Civil servants plan to go to the STF against the Benefits PEC

Associations of civil servants plan to present to the Federal Supreme Court (STF) a Direct Action of Unconstitutionality against the Benefits PEC.

Members of at least two associations are involved in the articulation: Sindifisco (a trade union entity representing the Tax Auditors of the Federal Revenue) and Conamp (National Association of Members of the Public Ministry), which are already studying the legal theses to support the action. Other associations are also being sought to strengthen the action.

“The studies are not completed yet. But there is a concern regarding fiscal responsibility, the elimination of ethical barriers during the electoral period. One cannot eliminate constitutional precepts in favor of minor electoral elements. Some entities are concerned about the matter. There is topic monitoring. What moves us is the question of the Constitution. If there is a violation of the Federal Constitution, of the rules of inspectors, this can lead to a lawsuit in the STF”, he told the CNN the president of Conamp, Roberto Livianu.

The Institute I Do Not Accept Corruption would enter as amicus curiaea legal figure that means a party interested in the action that would enter to provide subsidies to the court.

The New Party has already announced that it will go to the STF if the PEC is approved, which reinforces the trend towards judicialization of the proposal.
