CNJ removes judge who granted house arrest to faction leader in Bahia

The National Council of Justice (CNJ) decided this Tuesday (17) to remove judge Luiz Fernando Lima, from the Court of Justice of Bahia (TJ-BA), for granting house arrest to Ednaldo Freire Ferreira, known as Dadá, leader of criminal faction Bonde do Maluco (BDM).

Dadá, who had been serving a sentence of 15 years and 4 months in prison since 2018, was granted house arrest on October 15. The justification given was that the defendant was the father of a child with autism and that his stay in prison could worsen his son’s health condition.

The decision was revoked a few hours later, but Dadá had already been released from the maximum security prison where he was held in Pernambuco. Since then, he has not been found by authorities and is considered a fugitive by the courts.

Accused of association with drug trafficking, homicide and torture, he is considered one of the main leaders of BDM, one of the most dangerous criminal organizations in Brazil, operating predominantly in the state of Bahia and other states in the Northeast.

The decision to remove Judge Lima was taken unanimously by the CNJ Plenary, after the National Justice Inspectorate initiated a disciplinary procedure to investigate the judge’s conduct.

The CNJ assessed Judge Lima’s action as “serious and unjustified”, as it benefited the defendant in a specific and differentiated manner.

According to the agency, the measure “seriously tarnished the image of the Judiciary”. Judge Lima will have 30 days to present his defense before the CNJ.

Reaction

The CNJ’s decision was welcomed by authorities and civil society. The Minister of Justice, Anderson Torres, stated that the measure “demonstrates that the State does not tolerate impunity”.

The president of the Association of Brazilian Magistrates (AMB), Luiz Fux, highlighted that the decision “is an example that the Judiciary is attentive to its own members”.

The prosecutor of the Federal District and Territories, Ricardo Cappelli, who is following the case, also highlighted the importance of the CNJ’s decision for public safety.
