CNJ will investigate the behavior of the judge who shouted at a witness in SC

The National Council of Justice (CNJ) will investigate the conduct of substitute Labor judge Kismara Brustolin, from Santa Catarina.

The body ordered the filing of a disciplinary complaint (RD) against the judge for her behavior during a hearing that took place remotely, on November 14, at the Xanxerê Labor Court (SC).

The objective is to find out if there has been any violation of the functional duties of the position. The decision to open the procedure was made by the National Inspector of Justice, Luis Felipe Salomão, signed this Wednesday (29).

According to the CNJ, “the judge’s attitude during the hearing may have violated the judiciary’s functional duties, including the duty of civility towards lawyers, parties and witnesses”.

In a video, the judge appears to shout, reprimanding a witness for not calling her “your excellency”. “I caught your attention and you have to respond like this: what do you want, Your Excellency?”, she complains.

The witness tries to continue speaking, however, the judge shouts again and calls him “mouthy”. Then she talks about canceling the testimony due to impoliteness and excludes the man from the video conference.

The conduct also provoked a demonstration from the Brazilian Bar Association (OAB), which, in a note, requested an investigation into his behavior during the hearing. The Regional Labor Court of the 12th Region (TRT-SC) accepted the request and removed the judge.

The judge has 15 days to present a preliminary defense. After the deadline, the procedure may be included on the agenda of the Plenary of the National Council of Justice, to later decide on the initiation of an administrative disciplinary process.
