THE CNN had access to the draft resolution that the United States presented this Thursday (24) to the other UN Security Council countries, including Brazil. The document has two pages and is divided into 20 topics. The proposal is still under negotiation and may change.
In it, the United States stipulates that the Council “decides that the Russian Federation shall immediately cease the use of force against Ukraine and shall refrain from any other unlawful threat or use of force against any UN member state.”
It also provides that “the Russian Federation must immediately, completely and unconditionally withdraw its military forces from the territory of Ukraine within its internationally recognized borders”.
The document further “condemns in the strongest terms the aggression of the Russian Federation against Ukraine in violation of Article 2, paragraph 4 of the United Nations Charter” and considers it “a violation of the territorial integrity and sovereignty of Ukraine and inconsistent with the principles of Charter of the United Nations”.
It also says that “the situation in Ukraine constitutes a violation of international peace and security and that the Russian Federation has committed acts of aggression against Ukraine”.
The UN Security Council is made up of 15 countries, of which five are permanent (United States, France, United Kingdom, China and Russia) and another ten rotating members, a position recently assumed by Brazil.
The full text of the draft resolution follows. In diplomatic language, “PO” means “Operational paragraph”, where actions are required; and “PP” means “Preambular Paragraph”, which recalls principles and previous decisions related to the specific case.
“The Security Council,
PP1 – Recalling the obligation of all States, under article 2 of the Charter of the United Nations, to refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any State, or in any other manner inconsistent with the purposes of the United Nations and to resolve its international disputes by peaceful means;
PP2 – Recalling their primary responsibility under the United Nations Charter for the maintenance of international peace and security;
PP3 – Recalling the 1975 Helsinki Conference on Security and Cooperation in Europe Final Declaration and the 1994 Budapest Memorandum;
PP4 – Recalling its Resolution 2202 (2015) which urges the parties to fully implement the “Package of Measures for the Implementation of the Minsk Agreements”, including a comprehensive ceasefire as provided for therein, as well as emphasizing the importance of full implementation of the Protocol Minsk of 5 September 2014 and the Minsk Memorandum of 19 September 2014;
PP5 – Approving the Secretary General’s call for the Russian Federation to stop its offensive against Ukraine;
PP6 – Condemning the February 23, 2022 declaration by the President of the Russian Federation of a “special military operation” in Ukraine,
PP7 – Expressing great concern about reports of civilian casualties,
PP8 – Determining that the situation in Ukraine constitutes a violation of international peace and security and that the Russian Federation has committed acts of aggression against Ukraine,
PP9 – Acting in accordance with Chapter VII of the Charter of the United Nations,
OP1 – Reaffirms its commitment to the sovereignty, independence, unity and territorial integrity of Ukraine within its internationally recognized borders;
OP2 – Condemns in the strongest terms the aggression of the Russian Federation against Ukraine in violation of Article 2, paragraph 4 of the Charter of the United Nations,
OP3 – Decides that the Russian Federation shall immediately cease the use of force against Ukraine and will refrain from any other unlawful threat or use of force against any UN member state;
OP4 – Decides that the Russian Federation must immediately, completely and unconditionally withdraw its military forces from the territory of Ukraine within its internationally recognized borders,
OP5 – Condemns the decision of the Russian Federation of 21 February 2022 relating to the status of certain areas of the Donetsk and Luhansk regions of Ukraine as a violation of the territorial integrity and sovereignty of Ukraine and inconsistent with the principles of the Charter of the United Nations ;
OP6 – Decides that the Russian Federation will immediately and unconditionally reverse the decision related to the status of certain areas of the Donetsk and Luhansk regions of Ukraine;
OP7 – Invites the Russian Federation to comply with the Minsk agreements and to work constructively on relevant international structures, including the Normandy Format and the Trilateral Contact Group, for their full implementation.
OP8 – Calls on all parties to allow and facilitate prompt, safe and unimpeded access to humanitarian assistance to those in need in Ukraine, to protect civilians, including humanitarian personnel and people in vulnerable situations, including children, and respect their rights;
OP9 – Condemns all violations of international humanitarian law and urges all parties to strictly abide by the relevant provisions of international humanitarian law, including the 1949 Geneva Conventions, and international human rights law, as applicable;
OP10 – Welcomes and urges the continued efforts of the Secretary-General, UN Member States, the Organization for Security and Cooperation in Europe and other international and regional organizations to support the de-escalation of the current situation, and also the efforts of the United Nations to respond the humanitarian and refugee crisis that the Russian Federation’s aggression created;
OP11 – Decides to remain actively monitoring this issue.”
