Cockfighting: Court fines man R$250,000 for crime in the interior of SP

A man was fined R$250,000 for promoting cockfighting in the interior of São Paulo. The decision of the 1st Chamber Reserved for the Environment of the São Paulo Court of Justice took place in the last days of December 2024.

The case occurred in Ribeirão Preto, around 315 kilometers from São Paulo, following an action by the Environmental Inspection Coordination of the Military Police of the State of São Paulo, which identified an “arena” organized for fights between animals of the same species, resulting in bad behavior. environmental treatment and crime.

The defendant, convicted in the first instance, filed an appeal to annul the fine or reduce the amount to R$3,000, claiming that he did not participate in the cockfight, but was merely present in the area.

The defense also questioned the lack of motivation for imposing the fine. However, the São Paulo Court of Justice upheld the first instance decision, considering that the materiality of the infraction was proven and that the fine was correctly applied.

What the law says

SMA Resolution No. 48/2014, of the State of São Paulo, provides for a fine of R$3,000 per individual for those who carry out, promote or participate in fights between animals. Federal Law No. 9,605/98, in turn, allows the conversion of the fine into services for preserving, improving and recovering the quality of the environment.

However, Federal Decree No. 6,514/2008, which regulates Law No. 9,605/1998, provides for this possibility only for offenses relating to pollution and other environmental offenses established in articles 61 et seq. of Law No. 6,514/2008.

The case’s rapporteur, judge Allende Ribeiro, highlighted that the sentence applied to the man was individualized, considering the seriousness of the facts and the defendant’s economic situation. The fine was reduced from R$501,000 to R$400,000 and later to R$250,000.
