Commission launches infringement proceedings against five countries over exchange of criminal record information

The European Commission announced today that it is initiating infringement proceedings against five member countries, including Greece, due to incorrect application regarding the exchange of criminal record information.

In particular, the Commission will initiate infringement proceedings against Bulgaria, Cyprus, Greece, Malta and Portugal for incorrect application of Framework Decision 2009/315 / JHA on the exchange of criminal record information and Decision 2009/316 / Council JHA establishing the European Criminal Records Information System (ECRIS). Launched in April 2012, this system enables the electronic exchange of criminal records between authorities across the EU. It ensures that information is exchanged between EU countries in a uniform, fast and compatible manner. It also provides judges, prosecutors and other competent authorities with easy access to comprehensive information on the criminal history of the persons concerned, including the EU countries in which the person has been previously convicted. It thus prevents offenders from escaping their criminal past when moving from one EU Member State to another.

The Commission identified problems in Bulgaria, Cyprus, Greece, Malta and Portugal regarding the electronic interconnection and effective exchange of criminal record information through ECRIS, as well as the notification of all new convictions and updates to the Member State of nationality. of the perpetrator. Another reason for concern is the responses to requests for information about convictions: sometimes they were not given within the deadline, other times no answers were given at all.

Greece and the other four Member States now have two months to clarify the measures they have taken to ensure that these instruments are properly implemented in practice.
