Companies are required by law to release employees to vote

On election day (2), some professionals will work because they were summoned by the companies or even by the Electoral Justice to help in the process as poll workers.

According to lawyer Guilherme Bohac, as the election takes place on a Sunday, the worker has the right to compensate for the day or be paid double. According to the Consolidation of Labor Laws (CLT), in its Art. 9, “in activities in which it is not possible, due to the technical requirements of the companies, to suspend work, on civil and religious holidays, the remuneration will be paid in double, unless the employer determines another day off”.

The lawyer also explains that companies are required by law to release these workers long enough so that they can attend the polling stations to vote, without deductions from their salary for the hours they were absent, if they are unable to vote before or after their job.

The release period must take into account the round trip and possible queues at the polling station. According to Law 4,737/1965 – the Electoral Law, preventing or hindering the exercise of the vote is an electoral crime punishable by detention of up to 6 months and payment of a fine.

In the event that the worker votes in an electoral domicile different from the one where he works, the absence cannot be discounted. The rule also applies to workers who are not obliged to vote as they are over 70 years old and young people between 16 and 18 years old. The company cannot demand that these hours of absence be compensated on the day or at another time.

Workers summoned to act as poll workers in elections are entitled to double time off on the days they were available to the Electoral Court. If you work on October 2, in the first shift, you will have two days off from your work, without prejudice to your salary, whether in the private sector or in the public sector.

If there is a second shift, you will have two more days off from your job.

There is no deadline for the worker to take the day off, but the Electoral Justice guides that this happen soon after the day of the vote. Days off must be agreed between employer and employee upon presentation of a receipt from the Electoral Court. Every polling station receives a declaration issued by the electoral judge that proves the provision of service during the election.

The service provided to the Electoral Justice is not remunerated. However, the board members receive a meal allowance in the amount of R$ 45.00.
