The 27th Chamber of Private Law of the Court of Justice of São Paulo (TJ-SP) ordered an event producer and a ticket sales company to compensate fans who had to watch a Coldplay show on their cell phones at the Morumbi Stadium due to over crowded.
After the heavy rain that occurred on the day of the show, although fans entered the stadium, they were unable to access the bleachers due to overcrowding, and had to watch the show on their cell phones.
Compensation for moral damages was set at R$7,000 for each plaintiff. Since there are three applicants, the value is R$21 thousand. The defendants must also reimburse the amount paid for the tickets.
In his vote, the rapporteur of the appeal, judge Rogério Murillo Pereira Cimino, highlighted that there was no type of assistance from the organizers, which constituted a failure in the provision of the service.
“It was up to the defendants, organizers of a large event, to provide effective support to spectators, guaranteeing them access to the venue effectively and safely, which they failed to do,” wrote the magistrate.
