Compensation for family members of bricklayer Amarildo will be judged tomorrow by the STJ

The payment of compensation for family members of bricklayer Amarildo Dias de Souza will be analyzed in the judgment of the Second Panel of the Superior Court of Justice this Tuesday (2). He disappeared in July 2013 after being taken away by military police officers from the Pacifying Police Unit (UPP) in Rocinha, in the south of Rio de Janeiro. The body has not yet been found and no family member of the bricklayer has been compensated.

The Amarildo case had wide repercussions and mobilized civil society. In 2016, 12 police officers were arrested for torturing, killing and hiding Amarildo’s corpse, including the unit’s commander, Major Edson Santos.

The family members, represented by lawyer João Tancredo, want the right to compensation to be recognized and the decision of the Justice of Rio to be upheld so that Amarildo’s wife and children receive R$500,000 each and the victim’s brothers receive R$100,000. , for moral damages.

The State of Rio has appealed the decision to pay compensation to the family and wants to reduce the compensation to 300 minimum wages for the widow and 220 minimum wages for each of the children.

For Amarildo’s sister, the State Attorney General’s Office asks that the conviction be annulled or that the amount of compensation be a maximum of 25 minimum wages.

The first date set by the STJ to judge the case was December 14, 2021. Then, it was rescheduled to February 15, 2022. On that day, three ministers voted to maintain the decision of the Court of Justice of Rio and one was against it. There was a request for a view when there was already a majority, which rescheduled the trial to June 21. After another postponement, the issue is ready to be judged, at last, this Tuesday.
