Competition Commission: On-the-spot inspection in the optical trade sector

The Competition Commission, in the context of an ex-officio investigation following a relevant complaint, today carried out a sudden on-site inspection in a company active in the optical trade sector, regarding any anti-competitive practices under Articles 1 and 2 of Laws 3959/2011 and 101/102 of the Treaty on the Functioning of the European Union (TFEU). EA is examining possible practices of influencing resale prices and banning members of its distribution network from selling products through online platforms.

This unannounced audit is a preliminary step in the context of EA’s investigation to identify anti-competitive practices under the provisions of Law 3959/2011.

It should be noted that conducting such audits does not prejudge that companies or associations of undertakings have engaged in anti-competitive conduct nor does it prejudge the outcome of the investigation.

EA, custodian of the proper functioning of the free market, is responsible for the implementation of competition rules based on Law 3959/2011 and Articles 101/102 TFEU.

– Articles 1 of Law 3959/2011 and 101 TFEU prohibit partnerships between companies (agreements, decisions of associations or concerted practices) that have as object or effect the restriction of competition.

– Articles 2 of Law 3959/2011 and 102 TFEU prohibit the abusive behavior of companies with a dominant position in the market.
