Competition Commission: Until 13/4 the comments on Delivery Hero’s commitments for the deal with the Mouchalis group

Following a relevant Proposal proposing the non-approval by the Competition Commission (“EA”), of the notified concentration concerning the acquisition by the company under the name “DELIVERY HERO SE” (hereinafter “Delivery Hero”) of exclusive control over of the companies a) “ALPHA DISTRIBUTIONS SA”, b) “INKAT SA”, c) “DELIVERY PC” and d) “E-TABLE PC” (see Press Release here), Delivery Hero submitted on April 6, 2022 a Commitment Notification Form.

The purpose of the proposed commitments is to address any doubts as to the compatibility of the concentration in question with the requirements of the competition, as a result of combining the new entity’s significant activities in the online mediation market for online restaurant booking services. e-table and in the online mediation market for the sale of ready-made food through the e-food platform.

In this context, any interested parties are invited to comment on the proposed commitments and to express their views on the ability of the commitments to eliminate the competition concerns identified in the Presentation.

Interested parties are invited to submit their substantiated comments to the email address [email protected] no later than Wednesday, April 13, 2022. The comments should be submitted in confidential and non-confidential version, as well as in editable word format.

Finally, it is reminded that the Recommendation is not binding on the Competition Commission, which will decide taking into account the facts of the evidentiary process and the views of the parties involved.
