Congress enacts law that allows direct sale of ethanol to gas stations

The National Congress enacted Law 14,367, which authorizes ethanol producers and importers to sell directly to gas stations.

The Law originated in Provisional Measure 1,100, sent to Congress by the federal government, which was approved without changes, so it is now enacted.

The text is published in the Official Gazette this Wednesday (15).

In addition to allowing the direct sale of ethanol at gas stations, the act makes adjustments to the PIS/Pasep taxation on the production and commercialization chain of hydrated fuel ethanol.

In September of last year, Congress had approved an MP dealing with the same topic, but the President of the Republic, Jair Bolsonaro, vetoed the articles referring to the direct sale of the product at gas stations with the justification that the inclusion of cooperatives in this measure would cause an undue tax waiver.

Despite Bolsonaro’s vetoes, direct sales have already been authorized by the National Agency for Petroleum, Natural Gas and Biofuels (ANP).

The sector, however, sought authorization in law, considering that, in this way, the permission becomes more consistent and generates less insecurity.

The new law redeems points that were vetoed.

According to the text, the commercialization company and the importer of hydrated fuel ethanol are authorized to market the product with the distributing agent; fuel retailer; carrier-dealer-retailer; and foreign market.

The product can also be sold with hydrous ethanol production cooperatives.
