Congress overturns veto sections of the “BR do Mar” project

The National Congress this Thursday (17) overturned parts of the presidential veto of the project that created the Cabotage Transport Stimulus Program, known as “BR do Mar”. The text will go to promulgation.

Of the 31 vetoes that were on the agenda, only 14 were appreciated. The analysis of the most controversial, such as those referring to the privatization of Eletrobras, the provisions of the Annual Budget Law (LOA), which includes cutting federal expenses, and the breach of patents, were postponed.

Among the devices recovered is the term of validity of the Reporto (Tax Regime for Incentive to Modernization and Expansion of the Port Structure). With that, the period was extended until December of the next year.

Reporto suspends the collection of IPI, PIS/Cofins and Import Tax on the purchase of machinery, equipment and other goods for port terminals. As justification, Bolsonaro stated that the law “incurs in an addiction to unconstitutionality and contrary to the public interest”.

According to the president, “it would imply a waiver of revenue without the presentation of an estimate of the budgetary and financial impact and of the compensatory measures”. The sanction of BR do Mar was published in an extra edition of the Official Gazette on January 7th.

Lawmakers maintained President Jair Bolsonaro’s veto of the law that changes the rules for distributing seats in proportional positions, such as federal, state, district and councilors, called “electoral leftovers”.

Two parts of the project were vetoed: one regarding which allows each party to register candidates for up to 150% of the respective vacancies in the federative units and another foresaw that, in municipalities with up to 100 thousand voters, each acronym could register names for a councilor of up to 150% of the number of seats to be filled.

The National Congress also maintained presidential vetoes to MP 1063/2021, which regulated operations for the direct purchase and sale of ethanol from producers and importers to gas stations.

In total, nine provisions were maintained, including the one that authorizes the producer to negotiate directly with fuel distributors.

The president’s full veto of the project that extended until the end of 2021 the validity of public tenders approved until March 20, 2020 because of the Covid-19 pandemic was also rejected.

In other words, the deadlines of all public notices approved until this date, when the state of public calamity was recognized, will be suspended. As justification, the president stated that the proposal was against the public interest by suspending the counting of deadlines.

“The period has already elapsed, which could imply the application of retroactive effects when restoring the validity of tenders already closed and cause legal uncertainty”, he explained. However, the Executive itself prohibited the admission of new servers last year.
