Convicted of 8/1 attacks is detained in Buenos Aires

Sentenced to 17 years in prison for the attacks on the Three Powers on January 8 last year, Brazilian Joelton Gusmão de Oliveira, 47, who was on the run in Argentina, was arrested on Thursday (14) in the city of La Plata , in Buenos Aires.

According to the police of the province of Buenos Aires, Gusmão de Oliveira was detained after police officers who were roaming the city’s streets observed that he had a “suspicious attitude”. The police report says that, when investigating the Brazilian’s data, they identified that there was a request for “capture and detention” against him, following a request for extradition by the Brazilian justice system.

“Gusmão is immediately detained and subsequently transferred,” says the police report, indicating that he was convicted in Brazil for violent abolition of the democratic rule of law, coup d’état, qualified damage, deterioration of listed property and armed criminal association .

Gusmão’s daughter, Agnes, denies the police version. According to her, he went to renew his temporary residence at an Immigration department in La Plata, when he was warned that he would have to give a statement because there was an extradition request against him.

“He was taken to give a statement and was detained, which is irregular. They took him without an interpreter and didn’t let the lawyer have access to him,” he told CNN .

According to Agnes, Gusmão’s documentation is in order. “He was arrested without any justification. We were not informed of the reason, and the arrest occurred when he went to present himself [para renovar a documentação] as he commonly did”, he states.

This is the first time that one of those convicted of the 8/1 attacks, who are on the run in Argentina, has been detained. At least 181 Brazilians have requested refuge in the country since January this year, according to the National Commission for Refugees (Conare), the body responsible for granting political asylum. As of the end of September, all requests were still being analyzed.

In October, STF minister Alexandre de Moraes ordered the extradition of 63 Brazilians considered fugitives from justice for attacks on January 8th. Most of the requests have already been delivered by the Brazilian embassy to the Argentine chancellery.

Gusmão, however, is an asylum seeker. While the request is being analyzed, the applicants cannot be extradited. According to the UN High Commissioner for Refugees (UNHCR), asylum seekers should also not be detained.

Buenos Aires provincial police told CNN that Gusmão will be made available to Argentine justice, which will determine whether or not he should be released.
