Couple is convicted of baby’s death based on the “Henry Borel Law” in SC

A couple of caregivers were convicted by the Jury, last Friday (11), in Caçador (SC). They were held responsible for the death of a three-month-old baby in July 2022.

The caregiver couple was convicted of the brutal death of a three-month-old baby in Caçador, in the interior of Santa Catarina. The crime occurred on July 18, 2022, while the child’s mother was working.

The trial took place at the Caçador District Forum and lasted more than 12 hours. The man was convicted of qualified homicide, while the woman was found guilty of omission. The man became angry with the child’s crying and violently attacked him, causing serious injuries that led to his death.

In July 2022, the child was brutally attacked by one of her caregivers while her mother was working. The injuries caused by the blows were so serious that the child could not resist and died three days later, even after being transferred to a hospital in Florianópolis.

After a long period of waiting, the case reached the Caçador Jury Court. The session, which lasted more than 12 hours, was marked by great emotion from the mother, a Venezuelan woman, who witnessed the trial. The Public Ministry of Santa Catarina (MPSC) presented overwhelming evidence that led to the conviction of the accused.

Penalties applied

The man, mainly responsible for the attacks, was sentenced to 18 years and eight months in prison for qualified homicide. The qualifiers considered by the jury were the futile motive (the child’s crying) and the homicide against a minor under 14 years old, provided for in the Henry Borel Law .

The woman, who was also the child’s caregiver, was sentenced to one year, nine months and 10 days in open prison for manslaughter by omission. The court understood that she could have prevented the crime, but did not act to protect the child.

The conviction of the accused was received with relief by the victim’s mother, who followed the entire judicial process. Prosecutor Diego Bertoldi highlighted the importance of the conviction for society.

“The punishment applied shows that acts of violence, especially against a child, will not be tolerated. It is an important step so that we can all live in a society where justice prevails”, said the prosecutor in the case.
