Spanish A court has vindicated a man who was fined for driving around naked on the streets of a city in Valencia and later tried to attend his trial wearing only…shoes.

In its statement, the High Court of Valencia said it had approved the appeal against the lower court’s decision and was canceling the fines imposed on the man for walking around the streets of the town of Aldaya in plain clothes.

The Supreme Court admitted, however, that there is a “legislative gap” in Spain regarding nudism.

At his first trial, Alejandro Colomar, 29, was seen arriving at court wearing only a pair of hiking boots, but was stopped and ordered to change clothes to enter the building. He claimed at trial that the fines violated his right to ideological freedom. He told Reuters that he began to strip in public in 2020, and more people supported him than insulted him when he went around naked. Once, however, someone threatened him with a knife.

“The fine makes no sense. I was accused of showing off. According to the dictionary, this presupposes sexual intent and has nothing to do with what I did,” he explained.

Nudism has been legal in Spain since 1988. Anyone can walk naked on the street without being arrested, but in some areas, such as Valladolid and Barcelona, ​​laws are in place to “regulate” nudism, especially when it’s not on beaches. The court noted that Aldaia does not have a law prohibiting nudity.

The Supreme Court found that Colomar was “restricted” to walking around naked in two different streets of Aldaya, on different occasions, and his behavior did not threaten public order or the safety of citizens.
