Court of Justice and Government of Roraima disagree on Yanomami children placed for adoption

The Court of Justice and Roraima differ on the number of Yanomami children who did not return to their families and were placed in the process of adoption.

The TJ-RO says that, in a preliminary analysis, five Yanomami indigenous people were identified in institutional care and two in adoption processes.

The state government’s press office says that the children’s shelter has 6 Yanomami children, aged between 6 months and 12 years old, but none are in the process of being adopted.

Both the Court of Justice and the Government of Roraima do not point out, however, irregularities in the processes.

On January 30, the Indigenous Council of Roraima (CIR) reported that it had received complaints about Yanomami children being taken away from their parents and placed irregularly in shelters during visits to public services in cities in the state.

The agency demanded explanations from authorities about minors who are sheltered, in the process of adoption, hospitalized or who have already been adopted.

The national secretary for the Rights of Children and Adolescents, Ariel de Castro Alves, explained to CNN that these children were in situations of risk due to failures of the public power in hospital care. The secretary was in a delegation that visited the State of Roraima between January 29 and February 2, in order to identify violations of Human Rights.

According to him, the concept of family in indigenous communities should be treated more broadly, considering that the entire indigenous community should, in principle, be treated as a family.

“Accommodation in legal shelter services is exceptional and should be avoided. Likewise, if they are orphaned due to the death of their father and mother, they must be under the care of other family members, such as uncles and grandparents, as well as other adults in the indigenous community”, he highlighted.
