Court orders preventive detention of those involved in death of councilman’s brother on the coast of SP

The São Paulo Court of Justice (TJSP) ordered the preventive detention of the three involved in the death of councilor Tiago Peretto’s brother. Igor Peretto was found dead in Praia Grande, on the coast of São Paulo, on August 31st.

Mario Vitorino, Marcelly Peretto and Rafaela Costa da Silva were together in Marcelly’s apartment before Igor was found there. Marcelly surrendered to the police after an arrest warrant was issued. Mário and Rafaela are also arrested.

The measure was adopted on October 31 following a complaint from the Public Prosecutor’s Office which stated that the victim was brutally murdered with several stab wounds when the three defendants lured her to the scene of the crime.

Furthermore, prosecutor Ana Maria Frigerio Molinari, responsible for the complaint, highlighted the seriousness of the act and the risk to public order that keeping those accused free would represent.

“After the crime, the three tried to hide the evidence and simulate a defense, fleeing the scene together. The brutality of the crime generated great repercussions in society, highlighting the need for precautionary measures”, stated the MP.

The Public Prosecutor’s Office also argued that the crime was motivated by base reasons and committed in a cruel manner, “which justifies preventive detention, even in the face of favorable personal conditions of the accused”.

In a note, the agency said that the request includes the initiation of criminal proceedings and the setting of a minimum value of R$300,000 to repair the moral damage caused to the victim’s heirs.

When accepting the Public Prosecutor’s complaint, the Court stated that proof of the materiality of the crime was evidenced by the extensive material produced by the police investigation, which includes police reports, interrogations, among others.

“Note that, in summary judgment, Mário and Marcelly would be at the scene of the crime. As for the defendant Rafaella, despite having left the scene, there is evidence that she maintained communication with the others involved”, stated the TJSP.

THE CNN contacted the defendants’ defense and is awaiting a response.

On August 31, Igor Peretto, brother of councilor Tiago Peretto, was found dead in his sister Marcelly Peretto’s apartment, in Praia Grande, on the coast of São Paulo.

According to the Public Security Secretariat of the State of São Paulo (SSP), Mário Vitorino, who is married to Marcelly Peretto, had an affair with Rafaela Costa da Silva, the victim’s wife, that is, he is the victim’s brother-in-law and friend.
