The Labor Court ordered the airlines Voepass and Latam to pay a pension to the widower of flight attendant Débora Soper Ávila, who died in the accident involving the Voepass ATR-72, which crashed in the city of Vinhedo, in the interior of São Paulo, in August this year. The decision can still be appealed.
The amount is equivalent to two thirds of the salary received by Débora . In the decision, from the 1st Labor Court of Ribeirão Preto, judge Luiz Roberto Lacerda dos Santos Filho stated that “the death of his wife caused financial losses in the maintenance of the home and his standard of living [do viúvo]”.
“I GRANT EMERGENCY PROVISIONAL GUARDIANSHIP to determine that the defendants, jointly and severally, pay to the author MARCUS VINÍCIUS ÁVILA SANT’ANNA, by the tenth business day of the following month, the amount equivalent to 2/3 of the last global salary of the deceased employee “, it says.
If the amount is not paid, companies will be fined.
Still in the decision, the judge stated that Voepass’s responsibility is latent, as it “objectively responds for the damages caused due to the activity it exploits placing greater burdens on its employees than other members of the community”.
Latam, in turn, “must also respond, in a preliminary analysis, for the damages caused, as the flight in which the accident was reported was in codeshare” with Voepass.
It is worth remembering that flight 2238 was sold by Latam, however, it was operated by Voepass, therefore, the decision states that, when entering into this type of agreement, the responsibility lies with both companies.
Remember the accident
Voepass flight 2283, formerly Passaredo, which left the city of Cascavel (PR) bound for Guarulhos airport, in São Paulo, crashed in Vinhedo, in the interior of the state of São Paulo, in the early afternoon of August 9. All 62 people who were on board the plane, prefix PS-VPB, model ATR 72-500, died from multiple trauma, according to the Scientific Police.
According to the partial report released by Center for Research and Prevention of Aeronautical Accidents (Cenipa), the co-pilot of the Voepass plane (2283), Humberto de Campos Alencar e Silva, aged 61, reported “a lot of ice” in the minutes before the crash of the Voepass ATR-72, in August.
The formation of ice on the aircraft’s wings was one of the hypotheses raised by experts that could explain the aircraft’s crash at the time. The aircraft crash killed 62 people, including 58 passengers, on August 9.
This was the sixth deadliest plane crash in Brazilian history.
