Court orders Voepass and Latam to pay pension to parents of accident victim

The São Paulo Court ordered the airlines Latam and Voepass to pay pension to the parents of a university professor who died in the plane crash in Vinhedo (SP), in August this year. The information was confirmed in a decision obtained by CNN this Wednesday (4).

The court decision, upon recognizing the companies’ joint responsibility for the accident, established the payment of three minimum wages to each of the teacher’s parents, considering the proof of the elderly couple’s financial dependence on their daughter.

The victim, a postgraduate professor, was on the flight to celebrate her partner’s birthday when the plane crashed. Her postdoctoral diploma was issued the day after the accident.

Judge Fernando Antonio Tasso, from the 15th Civil Court of the Capital, based the decision on the commercial agreement between Latam and Voepass that provided for the sharing of routes, including flight 2283, which crashed in the city of Vinhedo, in the interior of São Paulo, four months.

According to Leonardo Amarante, a lawyer representing the victim’s parents, highlighted the importance of the decision for other similar cases. “This decision is an important precedent, as it recognizes that relationships of economic dependence can manifest themselves in different ways, not limited to the dependence of parents on their children,” stated Amarante.

In addition to the pension, the teacher’s parents also request compensation for moral damages.

Wanted by CNN Latam informed that it “does not comment on ongoing processes”. Voepass stated that “information on legal issues is handled exclusively with family members and legal representatives”.

If payment is not proven within five days of receiving the decision, airlines may suffer a daily fine of R$1,000 for each day of delay, initially limited to 30 days.

Voepass flight 2283, formerly Passaredo, which left the city of Cascavel (PR) bound for Guarulhos airport, in São Paulo, crashed in Vinhedo, in the interior of the state of São Paulo, in the early afternoon of August 9. All 62 people who were on board the plane, prefix PS-VPB, model ATR 72-500, died from multiple trauma, according to the Scientific Police.
