Court will consider disqualifying prosecutor from Trump trial

The Georgia Court of Appeals will consider an attempt by Donald Trump and his co-defendants to disqualify District Attorney Fani Willis from the 2020 election subversion case.

In a brief order Wednesday, the court said it will hear an appeal from Trump and others challenging Judge Scott McAfee's ruling that allowed Willis to remain on the case.

No trial date has been set in the sprawling election subversion conspiracy case against Trump, and the decision to consider the appeal is another sign that efforts to delay a trial are being successful.

On Tuesday, a federal judge in Florida indefinitely postponed Trump's trial for mishandling confidential documents at his Mar-a-Lago estate. And the Supreme Court has yet to rule on Trump's arguments that he has blanket immunity from lawsuits while president, an issue that halted the Jan. 6, 2021, federal trial on related charges.

Willis' office declined to comment on the request.

Trump attorney Steve Sadow said the former president “looks forward to presenting arguments to the Georgia Court of Appeals as to why the case should be dismissed and Fulton County District Attorney Willis should be disqualified for her misconduct in this pursuit.” unjustified policy.”

In March, after Trump's lawyers and his co-defendants tried to prove their case against Willis and his prosecutor in the case, Nathan Wade, a Fulton County judge finally ruled that Willis would be allowed to continue to lead the case if Wade resigned.

McAfee found there was insufficient evidence to firmly prove that Willis benefited financially from her relationship with Wade, who defense attorneys said covered several vacations for the pair. Willis testified that he paid Wade the expenses in cash.

Weeks after the McAfee decision, Trump and several co-defendants appealed, arguing that Willis “covered herself and her office in scandal and discredit as she squandered her credibility and repeatedly and flagrantly violated the high ethical standards required of her position.”
