Cremesp punishes doctors for performing abortions with judicial authorization in SP

The Regional Council of Medicine of São Paulo (Cremesp) suspended the registration of two doctors who worked at the Vila Nova Cachoeirinha Hospital and Maternity, in the north of the city of São Paulo, for six months. The professionals were accused, among other things, of negligence and torture, for having performed abortion procedures on patients with judicial authorization.

A CNN found that one of the punished doctors coordinated the sector responsible for pregnancy termination procedures and the other performed a procedure called fetal asystole induction, necessary after 22 weeks of pregnancy.

The Vila Nova Cachoeirinha Hospital and Maternity was a reference in the technique in cases of abortion provided for by law, but its service was interrupted by the Municipal Health Department of São Paulo, under the justification of giving up space for other gynecological procedures.

The first complaint against the doctors was analyzed by Cremesp at the beginning of the month, but refers to a procedure carried out in 2022. A new complaint was made and will be analyzed this Tuesday (30), by the Cremesp plenary.

In both cases under evaluation, the abortion was performed in patients with fetuses that had malformation and no extrauterine life expectancy. On both occasions, the women were referred by the Public Defender's Office with a court decision in favor of abortion. The professionals have court documents as proof.

The authorship of the complaints is unknown to the doctors and their legal team. Sources heard by CNN they allege that the professionals are being victims of persecution and that the patients' medical records were illegally accessed by Cremesp and the Municipal Health Department, which represents a crime of breach of medical confidentiality.

A CNN contacted Cremesp and the São Paulo Municipal Health Department, but has not yet received a response.
