The São Paulo Regional Council of Medicine (Cremesp) did not analyze the second complaint against doctors investigated for carrying out abortion procedures at the Vila Nova Cachoerinha Hospital and Maternity, in the north of the city of São Paulo. The unit was a reference in the technique, in cases of abortion provided for by law.
Despite having carried out procedures with judicial authorization, the professionals were reported to the council, among other things, for negligence and torture.
After analyzing the first complaint, referring to a procedure carried out in 2022, both were suspended by Cremesp, even with evidence that they acted with authorization from the Court, as found by the CNN .
The second complaint, which would be analyzed in plenary yesterday afternoon (30), was not considered because the doctors' defense requested a writ of mandamus.
One of the doctors already punished coordinated the sector responsible for pregnancy termination procedures at the hospital and the other performed a procedure called fetal asystole induction, necessary after 22 weeks of pregnancy.
The Vila Nova Cachoeirinha Hospital and Maternity had its service interrupted by the São Paulo Municipal Health Department, under the justification of providing space for other gynecological procedures.
In both cases under evaluation, the abortion was performed in patients with fetuses that had malformation and no extrauterine life expectancy. On both occasions, the women were referred by the Public Defender's Office with a court decision in favor of abortion.
The authorship of the complaints is unknown to the doctors and their legal team. Sources heard by CNN they allege that the professionals are being victims of persecution and that the patients' medical records were illegally accessed by Cremesp and the Municipal Health Department (SMS), which represents a crime of breach of medical confidentiality.
The SMS says that no professional has been officially removed from the hospital in question so far.
In a statement, O Cremesp stated that it respects a woman's right to legal abortion in cases of victims of sexual crime.
“We emphasize that the Council is a federal authority that has the prerogative of supervising the ethical exercise of Medicine in any hospital institution in the State of São Paulo. Cremesp is investigating the facts that are confidential under the terms of the Law.”, completes the statement.
