The trial is scheduled for October 10th, at 1pm. In the request, filed on September 25, the mother and daughter’s lawyers claimed that their physical presence in front of the defendant would once again subject them to extreme psychological suffering.
“Exposing the victims to the presence of the defendant would be exposing them again to the unspeakable suffering they have already faced,” they argued in the document.
In the same request, the lawyers requested that the testimonies take place in a separate room, without the presence of Cupertino or the public, to guarantee the emotional integrity of the witnesses and the veracity of their reports.
However, on September 30th, judge Antônio Carlos Pontes de Souza rejected the request. He ordered that witnesses appear in person at the plenary session, but with the absence of Paulo Cupertino during their testimonies.
Remember the case
On June 9, 2019, Rafael Henrique Miguel and his parents, João Alcisio Miguel and Miriam Selma da Silva, were murdered while taking Isabela, Rafael’s girlfriend, to Paulo Cupertino’s house, in the South Zone of São Paulo .
The crime caused great commotion in the country. Cupertino, accused of the triple homicide, fled and remained at large for three years, until he was captured in May 2022, in an apartment in the South Zone of São Paulo.
According to Isabela’s report, on the day of the crime, her mother tried to talk to Cupertino about her relationship with Rafael. However, the conversation ended in tragedy when Cupertino fired several shots at Rafael and his parents. Forensics confirmed that at least 13 shots were fired, resulting in the deaths of the three at the scene.
