Daniel Silveira case is ready to go to trial in the Supreme Court since January

Awaiting a final decision from the ministers of the Federal Supreme Court (STF), the case of federal deputy Daniel Silveira has been ready to go to trial in the plenary of the Court since January this year. The information is from the anchor of the CNN Daniela Lima.

Silveira was arrested in February 2021 for having released a video with threats to members of the court. Minister Alexandre de Moraes, however, authorized the release of the parliamentarian, establishing precautionary measures, in November last year.

Following the Court’s procedure, Moraes’ decision was then forwarded to a reviewing minister. In January, after this review of the understanding, the case of deputy Daniel Silveira was released to be referred to the plenary of the STF.

Despite requests for the case to be ruled on as soon as possible, the president of the Supreme, Luiz Fux, decided to guarantee the first week of May for all the ministers of the Court to vote on the deputy’s future.

However, Silveira took advantage of the time available until the trial to return to politics on social media, this time as a possible candidate for the Senate for Rio de Janeiro.

The deputy then returned to publishing content on social networks aimed at engaging his electoral base, with content marked by bellicose speeches against political opponents.

Given this scenario and the parliamentary stance, Fux, who had initially defined that the trial would take place in May, agreed to bring forward the decision in plenary to April.

This Wednesday (30), the STF confirmed the scheduling of the trial of the criminal action against Deputy Daniel Silveira for April 20. The trend, according to ministers told CNN, is that the plenary of the court decides to condemn the congressman – which would make him ineligible.

Last Tuesday (29), the parliamentarian said he would not comply with a decision by Minister Alexandre de Moraes. The magistrate ordered the police to go to the Chamber to put an electronic ankle bracelet on Silveira.

Moraes had determined that Silveira started using the device last Friday (25), for failing to comply with precautionary measures and carrying out “repeated interviews on social networks and meeting with those investigated in the investigations”.

The minister also determined that Silveira not participate in “any public event throughout the national territory”. “The reiteration of unjustified failure to comply with any of these measures will naturally and immediately result in the reinstatement of the arrest warrant.”

The deputy said, however, that the minister’s decision would be “illegal” and that Moraes had to be “impeached and arrested”. Silveira decided that he would spend the night in the Chamber’s plenary, on the grounds that the police could not comply with the Supreme’s determination in the Legislative without authorization from the President of the House, Arthur Lira (PP-AL).
