The daughter of actress Samara Felippo, who was a victim of racism at a school in São Paulo, will be a listener during the hearing, which does not yet have a set date.
The decision was published in the Official Gazette this Wednesday (12) and is from the 2nd Special Court for Children and Youth.
When contacted, the São Paulo Court of Justice stated that “Processes involving children and adolescents are processed in secret from the courts, as determined by the Child and Adolescent Statute (ECA)” .
For the 14-year-old girl’s defense, the magistrate’s decision is “contrary to the law”.
In addition to the request for the right to speak, the defense will also request the magistrate’s removal from the case, as it understands that the authority is failing to comply with the ECA, which ensures that children and adolescents have the right to be heard by a Children’s judge.
Lawyer Hédio Silva Júnior also told CNN that the defense has not yet had access to the records.
“We are going to the STF so that the family has access to the records”, he stated.
For him, it is essential that the child has the right to speak and report what happened, in addition to the fact that the “principle of the best interests of the child (in this case, being heard) or the attacked adolescent cannot be greater than that of the victim”.
In April, attackers wrote racist insults in the girl’s notebook inside the Vera Cruz school, in the west zone of the capital of São Paulo.
