Deadline for rescheduling and reimbursement in the tourism and events sector is extended

O federal government published this Tuesday (22) the provisional measure (MP) that extends the deadlines for postponing and canceling services, reservations or events in the tourism and culture sectors as long as the cause is related to the coronavirus pandemic. Covid-19.

The text sets a new maximum deadline, until December 31, 2023, for the markdown of services in the tourism and culture sector that were purchased in 2022 and then canceled and for the use of credits provided by companies to consumers.

Per the text, the rules for rescheduling or obtaining credits that were already valid in 2021 and 2020 will continue in 2022. Now, service providers will need to provide credits, reschedule option or refunds to consumers in case of cancellation of services, reservations or events between January 1 and December 31, 2022.

The deadline for refunding cancellations in 2020 and 2021 remains the same, until December 31, 2022.

The MP releases artists, speakers and any professional hired to participate in canceled or postponed events, shows or shows between January 1, 2020 and December 31, 2022 from immediately refunding the amounts that would have been paid for the service, provided that the event is rescheduled. for a date until December 31, 2023.

The text also nullifies fines for canceling contracts with artists, speakers and other professionals who would participate in canceled events in 2022.

The objective of the measure, according to the government, is to maintain protection actions for the sectors of tourismculture and events that began at the beginning of the pandemic, in 2020, and had already been renewed in 2021, ensuring “the survival of these important economic segments”, avoiding judicializations and helping the sector to recover.

Specifically in the area of ​​tourism, the rules apply to agencies, carriers, theme and water parks, waterway cruises and other segments.

In the area of ​​events and culture, the MP encompasses cinemas, theaters, concert halls, promoters and service providers such as infrastructure and equipment rental, organizers, artists and speakers, among others.

The MP does not mention air tickets between the areas that will be covered by the rules. Airline rescheduling during the pandemic was governed by Law 14,034, which was not renewed and expired in January 2022. O CNN Brasil Business contacted the Ministry of Tourism to confirm the information, but received no response until the publication of this report.

Magda Nassar, president of the Brazilian Association of Travel Agencies (Abav), states that updating the MP was necessary mainly due to the dissemination of the Omicron variant, which led to further cancellations and postponements in the travel industry and prevented customers from being able to use credits already purchased or plan rebookings. “This new update of the law was urgent”, he says.

For the president of the Brazilian Association of Cruise Ships (CLIA Brasil), Marco Ferraz, “this MP brings important assistance so that agencies and operators can follow their recovery route in 2022”.
