Nearly nine years after the tragedy at the Kiss nightclub, four defendants were sentenced to prison last Friday (10), in the fire trial that resulted in 242 deaths in January 2013. But a habeas corpus granted to one of the accused will allow the four remain free until the preliminary injunction is analyzed by the Court.
At the end of last week’s judgment, the judges understood that the two club partners and the singer and a producer of the band who performed at the time of the tragedy knew of the risk of fire and, therefore, should be held responsible for the deaths. The thesis of the so-called “possible intent” was the reason for a legal clash between the defense and the prosecution and may establish a framework for similar cases.
