Defense of student who embezzled R$1 million from USP graduation will appeal conviction for fraud

Lawyer Sérgio Ricardo Stocco Caodaglio Giolo, who represents medical student Alicia Dudy Muller Veiga, 25, told CNN who will appeal the woman’s conviction for embezzling R$927,000 raised by dozens of colleagues for graduation from the Faculty of Medicine at the University of São Paulo (FMUSP) .

The penalty for the crime of fraud practiced continuously eight times, was fixed at five years of imprisonment in a semi-open regime, according to the Court of Justice of São Paulo (TJSP). The decision was made by the 7th Criminal Court of São Paulo, last Tuesday (2).

The conviction was made “without her having committed the crime of fraud that was imputed to her”, according to the defense. The lawyer claims that the evidence of Alicia’s innocence as the examination of the statements given during the criminal proceedings and “numerous electronic messages” exchanged between members of the graduation committee were disregarded.

Regarding the sentence applied, the defense believes that five years of semi-open regime did not comply with the parameters of the legally established “general rules”.

In a note, the lawyer refers to Alicia as a “resident student of the USP medical course”, which suggests that the woman is in the final stage of completing the course in the health area . A CNN asked the university for information about the student’s status; FMUSP stated that it will not comment on the case.

Misappropriation of R$1 million from the graduation committee

As president of the graduation committee, Alicia demanded that the company organizing the party transfer the students’ payments to a bank account in her name, which she hid from her colleagues, according to the TJSP.

The Civil Police investigation showed that the medical student used the money for his own benefit – when purchasing a cell phone and watch, renting a vehicle, paying for accommodation and financial investments.

In July 2022, Alicia tried to make a set of Lotofácil games at a lottery shop in the south of São Paulo. According to the Civil Police, Alicia won, in total, R$ 326 thousand in Lotofácil prizes after making dozens of high-value plays.

“He betrayed the trust of his peers, diverting resources that belonged to his classmates (which is more disgraceful than committing fraud against a victim whom one does not know), when the victims were not acting out of greed,” said judge Paulo Eduardo Balbone Costa, responsible for the sentence.

The graduation party for the medical school class that was the victim of the scam took place in January of this year, paid for by the company that managed the money.
