Divorce case, what changes: the Guardia di Finanza enters the scene to carry out checks on assets

Divorce case: at the Court of Milan the Guardia di Finanza, for the first time, will work alongside the judges of the ninth civil section – the one that deals with «family, separations and divorces» to resolve the conflict and economic implications that arise from disputes over the division of assets or disputes over maintenance payments. In practice, a delegated financier will be responsible for verifying requests for maintenance payments and asset declarations in divorce and custody cases.

The news of this innovation was introduced by the president of the Court of MilanFabio Roia, was the Guardia di Finanza of Milan, with a statement in which it was explained how the delegated financier, who will collaborate directly with the judges, will, if necessary, carry out investigations relating to the «requests of a financial nature made during the separation or judicial divorce or in any case of custody of minors».

Cause of divorce, what will be the task of the Financial Police

In addition to the “novelties introduced by the so-called Cartabia Law in terms of ascertaining the existence of family abuse, domestic violence or gender violence – the note states – judges specialized in family and personal law also deal with requests of a patrimonial nature”. For this purpose, a judicial police officer from the Gdf has been selected “who will collaborate directly with the judges in the execution of the investigations through the acquisition of judicial police documents and the processing of the findings emerging from the queries to the databases used by the Corps”.

This collaboration aims to ensure “a more effective judicial response, but also enhance the results of the investigations carried out by the judges during the preliminary investigation phase as part of the broader economic-financial police activities carried out by the Financial Police also through checks on assets held illegally”.

Recently the president of the ninth section, Anna Cattaneo, and the lawyer Giulia Sapi also signed a regulation on the procedures for conducting hearingsintroducing an “appropriate” dress code and respect between the parties during discussions in the courtroom, avoiding interruptions and offensive tones, apparently very frequent during hearings between former spouses.
