Doctor used his sperm for insemination, $ 10 million in compensation

It is a $ 10 million compensation offered to the families of Dr. Norman Barwin who for years worked in fertility clinics and used her own or other people’s sperm forinsemination of patients. The doctor did everything without the knowledge of patients and their families. There BBC he tells it as the first case of a legal settlement in a similar situation.

In the agreement, which must be signed by a judge to be valid, it is explained that the different applicants will have compensation based on what is established by the court starting from the level of damage suffered.

Part of the money will be reserved for tests and for a database del Dna which serves to identify biological fathers for hundreds of people.

There are 226 who have promoted the class action against Dr. Barwin who worked in two clinics in Ottawa, Canada. Some of the cases date back to the 1970s. The doctor has not been in business since 2014 and is over 80 years old.

Among the cases is that of Rebecca Dixon, 31 years old. He found that his real father was the doctor after developing a disease that no one else in his family had. It was her parents who started the lawsuit in 2016. To the newspaper Ottawa-Citizen she explained that she is not sure how this story will ever find a conclusion: “It is something that will stay with us for the rest of our lives. However, the end of the legal question will bring a little more peace to many ».

The agreement does not imply that the doctor must admit guilt. His lawyer says he continues to deny any wrongdoing. In 2019 he was stripped of his license. For the Ontario Physicians’ Association, “reprehensible,” the word in the manual, was not enough to define and condemn Dr. Barwin’s behavior.

The Canadian one is not the first case. Jan Karbaat, former director of a sperm bank in the Netherlands, who died in 2017, was the biological father of 49 children born with artificial insemination. The DNA test confirmed the suspicion that he had used his semen instead of that of the donors chosen by the families. He had confessed on his deathbed that he had about sixty children, but the doubts were already there: none resemble children with their parents and some very similar to Kaarbat.
