Document disputes the version of a businesswoman who says she owns land in Jericoacoara

The dispute over land ownership in the Jericoacoara Park region gained a new episode last Wednesday (13), after the discovery of a document that would confront the version of a businesswoman who claims to be the owner of the land. The Jericoacoara Community Council presented a document to the Attorney General of the State of Ceará, which contradicts the version of businesswoman Iracema Correia São Tiago about the ownership of the lands that were collected by the state.

The dispute over more than 1,600 hectares has been ongoing since 2010, when the businesswoman filed an administrative proceeding with the Chico Mendes Institute (ICMBio/MMA), claiming compensation for having three properties occupied.

Between 1995 and 2000, the government of Ceará promoted the process of land regularization in the region. The work was carried out by the Ceará Agrarian Development Institute (IDACE) which, at the time, did not find owners for the area, which was incorporated by the state, and years later, would give rise to the Jericoacoara National Park. The document was delivered by the Acaraú registry office, in a certification that there were no properties registered in the area in question.

According to the businesswoman’s version, the family was not notified of the land collection. In a statement about the case, the businesswoman’s family told CNN that, in 2004, Iracema was informed that she had missed the deadline to appeal against the State.

In 2010, the businesswoman began seeking compensation. Iracema’s defense says that the client was advised in 2004 to regulate the documentation of the area that was added to the Jericoacoara National Park.

According to the family, the National Park occupied 1600 hectares, covering parts of the businesswoman’s three farms. The state, however, never compensated the owner.

According to the family, the process of regularizing the area took time, because it was necessary to revisit several logistical and bureaucratic procedures, which involve a sequence of requests and production of studies and reports, in order to prove that the Union entered private property.

An agreement signed by the businesswoman and the State Attorney General’s Office, in October, gave the businesswoman ownership of parts of the area where Vila de Jericoacoara was located. The agreement, however, does not involve areas claimed by Iracema, which were designated as the National Park.

Recent discovery

Last Wednesday, a document published in the 2020 Official Gazette, according to the Council, would prove that the area claimed by the businesswoman actually belonged to another family.

The case against ICMBio and the claim for compensation against the Union, filed by Iracema, are contested precisely due to the lack of documents proving the origin of the property. Ordinance 102/2000, published on March 21, 2000, confirms that, at the time of the collection of unoccupied land in Jericoacoara.

The document was just one of those attached to the defense of the Jericoacoara Community Council and delivered to the Attorney General of the State of Ceará this Wednesday.

“In addition to documents, there is certainly also the memory of the civil servants, at the time led by superintendent Wilson Brandão, who worked on the processes and carried out a survey of existing properties in the region in the field and also made inquiries to the registry office to obtain certificates. The Council hopes to have full access to these administrative processes that are so important for the history and land security of Jericoacoara. A copy of the processes has already been requested by the Public Ministry. There will certainly be more documents found there that reinforce the truth that we have all always known”, comments Lucimar Marques, president of the Council.

What the parties say

ICMBio states that it has been conducting the land regularization process in private areas overlapping the Jericoacoara National Park, as determined by current legislation. Regarding legal proceedings, the institute preferred not to send any position.

PGE claimed this Friday (15), that rreceived the protocol for the new document just over a day ago. In a note, the Prosecutor’s Office states that the document “is in the analysis phase, which has been carried out in a thorough and detailed manner. Only after this analysis has been fully carried out will there be a position on its content. For now, PGE confirms receipt of the documentation”, he states.

THE CNN tries to contact the defense of Iracema Correia São Tiago, who is handling the cases against the Union and ICMBio. In addition to defending the businesswoman, Idace was also approached for a position on the new document. The space remains open.
