Dog will be entitled to alimony to treat illness, says MG Court

The Minas Gerais Court ruled, this Monday (9), that a resident of Conselheiro Lafaiete, a city located about 100 kilometers from the capital Belo Horizonte (MG), will be entitled to alimony from her ex-husband for the veterinary treatment of the pet dog acquired during the marriage.

According to the Minas Gerais Court of Justice, this is a provisional pension corresponding to 30% of a minimum wage . The animal suffers from exocrine pancreatic insufficiency, which requires special care and expensive treatments.

The dog’s owner, who is taking action against her ex-partner, attached videos, photos and documents to the lawsuit, confirming that the defendant is also responsible for the animal.

Multispecies family

Espagner Wallysen Vaz Leite, judge of the 1st Civil Court of the District of Conselheiro Lafaiete, based the decision on the concept of multispecies family relationship, characterized by a human family nucleus and their pet, where the emotional bond between the two is present, as defined by the Brazilian Institute of Family Law (IBDFAM).

“This concept has been gaining ground in Brazilian society, generating various discussions that have inevitably been taken to court. In this process, it is possible to see that the pet appears to have the affection of both parties,” explained the judge.

As is customary in cases involving post-divorce liabilities, a conciliation hearing will be held at the Judicial Center for Conflict Resolution and Citizenship. If there is no possibility of an agreement between the parties, the period for contestation begins and the case follows the regular procedures until the final judgment is scheduled.
