e-EFKA: Insurance right to uninsured divorced spouses with a payment of 42 euros / month

In the context of strengthening the social security protection provided to vulnerable groups of the social population, the right to benefits in kind (care) is now provided for the first time to the uninsured divorced, provided they remain uninsured even after divorce, as provided in Circular 80000/85840/774 -11-2021 of the Ministry of Labor and Social Affairs.

The uninsured divorced spouse must meet the following conditions in order to be eligible for the above benefits:

– the marriage has been dissolved after the completion of the 25th year of age
– no longer have the right to direct or indirect insurance for sickness benefits from any insurance fund,
– to submit an application for retention of entitlement to sickness benefits in kind within one year from the date of issuance of the final divorce decision
-to pay to e-EFKA a contribution of 6.45% on the minimum wage, ie € 42 per month and € 42.8 per month from 1-1-2022.
It is noted that the divorcee loses his right to benefits in kind in the following cases:

-with the retirement of the spouse from e-EFKA or from another body other than e-EFKA, which provides access to health care
-with the death of the divorced
-with taking up a job or activity or acquiring the status of insurable in e-EFKA, which leads to direct insurance of the spouse or the possibility of insuring him as indirectly insured in another way or with the retirement of the spouse from e-EFKA or from another institution except e-EFKA, which provides access to health care
-with the marriage regardless of whether or not insurance is provided for sickness benefits in kind, as the applicant is required to remain “divorced”
