The first day of Jonathan Messias Santos da Silva, 33, defendant for the death of Palmeirense fan Gabriela Anelli was marked by the statements of eight witnesses, on Monday (19). Gabriela, who was 23 at the time, died after being hit around her neck by a glass bottle during a confusion between Palmeiras and Flamengo fans near Allianz Parque, in Sao Paulo, on July 8, 2023.
Initially, 10 witnesses were summoned, but two were eventually dismissed (one of prosecution and one of defense). Among them is Yuri Batista da Silva, a fan who was next to Gabriela as she was hit.
The first part of the session had the testimonies of four prosecution witnesses. The first statement was that of expert Leandro Lopes dos Santos.
The defense assumed the posture of innocence of the defendant and that it was not possible to prove the materiality of the crime based on the report of the expertise. The expert showed, based on the synchronization of videos filmed by both fans, as it was possible to reach the probability that Jonathan is responsible.
In the afternoon and early evening, after a break, the four defense witnesses were heard.
Among them were the delegate Daniel José Orsomarzo, who answered the case on the day and arrested Leonardo Felipe Xavier Santiago after the testimony of Yuri. Later, Leonardo was released for lack of conviction that he threw the bottle he hit and killed the young woman.
Then it was Marcio Alves’s turn, security that closed the gate that separated the fans and where the bottle hit before hitting Gabriela. He states that the bottle came from the Flamengo fans, but it is not possible to determine who shot.
Finally, Patrício Eduardo Lamos Serpa, an expert hired by the defendant’s family, spoke about two videos that are attached to the process and were analyzed by him for a technical opinion.
The defendant was expected to be heard later this Monday, but Judge Isadora Moro suspended the session due to the time:
“I believe everyone is quite tired, both the jurors and the family members, we will close here,” he said.
The Jury Court will resume on Tuesday (20), at 8:30 am, with the interrogation of the defendant. Then there will be the debate between prosecution and defense.
