Eitan Biran, the Israeli Court of Appeal: “He must return to Italy”

Eitan Biran must return to Italy within 15 days. The court in Tel Aviv has Shmuel Peleg’s appeal dismissed, grandfather of the 6-year-old child, the only survivor of the tragedy of the Mottarone cable car, reiterating that the main place of life for the little one is Italy. The judge, while acknowledging “all the pain of the two grandparents”, believes that the child was illegally taken away: he established that Eitan “was kidnapped from his usual place of residenceAnd that he must return to Pavia “within fifteen days”.

To aunt Aya, sister of Amit, father of Eitan, a victim of the cable car disaster, the judge recommended that they undertake to ensure that the maternal family can also maintain contact with the child and can visit Travacò Siccomario, where he lives and where his parents also lived.

Eitan’s maternal grandparents (Shmuel Peleg and his ex-wife Esther) will now challenge the Italian court for the decision to have entrusted the nephew to his paternal aunt Aya Biran. Meanwhile, their Israeli lawyers have seven days to submit the appeal to the Supreme Court against the sentence of the Tel Aviv court. In their appeal they also contested the behavior of Eitan Biran’s aunt, who had no longer allowed her maternal grandparents to see the child unsupervised, letting her lawyers know that “We don’t trust anymore.”

September 11th Shmuel Peleg had gone to visit his nephew at his aunt’s house in Italy and had taken him for a ride, then, with the help of another Israeli citizen, he had taken him to Lugano by car and, with a private jet, had reached Tel Aviv with him. For the grandfather and the accomplice, the Pavia prosecutor had issued an international arrest warrant. According to the maternal family, “Eitan is a Jewish child and must grow up in Israel according to the tradition of his people.”
