A court in El Salvador on Monday sentenced a woman to 30 years in prison for killing her unborn daughter after she miscarried after a complication in her pregnancy, an organization said it was fighting to decriminalize abortion.
The woman, mother of a 7-year-old girl, suffered from a complication during her second pregnancy in 2019 and had to urgently seek medical help in a public hospital. But there they called the authorities and the police arrested her, according to the Citizen Group for the Decriminalization of Abortion.
A judge has sentenced the 28-year-old housewife, whose name has not been revealed for security reasons and is only referred to as Esme, after two years in prison. This is the first case of its kind in seven years, according to the organization.
“The decision is a major blow to the decriminalization of pregnancy emergencies, which according to the Inter-American Court of Human Rights should be treated as public health problems,” said Morena Herrera, the organisation’s president.
The women’s lawyers said in a statement that they would appeal the decision, noting that this was the first such decision during the presidency of Naib Boukele.
In the last 20 years in El Salvador, where abortions are completely banned even in cases of rape or when the mother’s health is in danger, 181 women have been prosecuted for complications in their pregnancies, according to the organization.
The Inter-American Court of Human Rights ruled in November that El Salvador had violated the rights of a woman identified as Manuela, who was jailed for abortion laws and died while serving a 30-year prison sentence.
