AGU must appeal against Alexandre de Moraes’ decision to cancel IPI reduction
The Attorney General’s Office (AGU) is expected to appeal the decision of the Minister of the Federal Supreme Court (STF) Alexandre de Moraes, who annulled a decree by President Jair Bolsonaro (PL) that reduced the Tax on Industrialized Products (IPI). The Ministry of Economy makes adjustments to the text that will be sent to the AGU.
“The magistrate’s decision violates paragraph 1 of Article 153 of the Federal Constitution, which is clear in saying that it is the exclusive competence of the President of the Republic to change tax rates. In addition, the IPI is an extra-fiscal tax, whose purpose is to encourage economic activity and industry in times of crisis. The minister’s decision generates a higher cost in any product and contributes to inflation. We will appeal,” he told the CNN an AGU source.
