Elon Musk files a lawsuit against Sam Altman

Billionaire Elon Musk filed a lawsuit against OpenAI and its CEO Sam Altman. He accuses the firm of unfair business practices, breach of fiduciary duty and breach of contract.

“OpenAI has actually become a subsidiary of the largest technology corporation in the world – Microsoft. Under new leadership, it is not only developing, but also improving artificial general intelligence (AGI) for commercial purposes instead of caring for the benefit of humanity,” the lawsuit says.

The billionaire is seeking an injunction against OpenAI, Altman and company co-founder Greg Brockman from profiting from AGI, by which Musk means ChatGPT-4.

The lawsuit states that previous iterations of this product were available as open source. According to Musk, the decision to abandon this approach was dictated by commercial goals, and not by concern for the good of society.

“GPT-4 is the opposite of the concept of “open AI.” Its source code is closed for obvious reasons. Microsoft simply wants to get rich from it, which would not be possible if OpenAI adhered to the agreement,” the papers indicate.

Here we are talking about the articles of incorporation, as the billionaire claims. Let us remember that Musk has previously repeatedly criticized OpenAI for abandoning the non-profit promotion model.

The owner of social network X (formerly Twitter) invested $50 million in the project at an early stage. He believes that OpenAI would not exist as such without his contributions.

Moreover, in February 2023, after the presentation of ChatGPT, Musk announced the development of a competitor to this solution. The program was released in the fall of 2023.
