EU Court sentences Hungary: Fails to meet asylum obligations – Breaks law

“First, the Court of Justice of the European Union finds that Hungary has not fulfilled its obligations by allowing the application for international protection to be rejected as inadmissible because the applicant arrived in its territory through a State in which the person was not persecuted or in danger of suffering “serious damage or in which (the state) is guaranteed an adequate degree of protection”, the court stated in a statement issued as broadcast by the Athens News Agency.

The Court of Justice of the European Union has also emphasized that Hungarian law restricted applicants’ right of access to international protection and the right of asylum seekers to be able to consult a legal or other counsel.

“The court considers that such a restriction cannot be justified by the objectives stated by the Hungarian legislature“That is, to avoid providing assistance for the abuse of the asylum process and illegal immigration based on fraud,” he added.
