Digital law specialist and coordinator of the ESPM law course, Marcelo Crespo, warned that the closure of X (formerly Twitter) operations in Brazil could have serious implications for compliance with court decisions related to the platform.
In an interview with CNN 360° Crespo explained that the absence of a legal representative of the company in the country makes it difficult to execute court orders, such as those issued by Minister Alexandre de Moraes, of the Federal Supreme Court (STF).
Consequences of disobedience
The lawyer highlighted that, if the platform does not appoint a new legal representative within the stipulated period, the consequences may include accusations of disobedience of the court order and possible attribution of criminal liability for crimes committed on the platform.
“If the minister orders the platform to be blocked, this could end up happening in the next few hours, in the next few days, and it will probably work based on an order issued to providers to block the application’s IP,” explained Crespo.
Access alternatives and legal implications
The expert also mentioned that, even with an eventual block, users could access the platform through virtual private networks (VPNs).
However, he warned that this practice could lead to legal implications: “It may happen that people who use VPNs can be identified and eventually even included in the investigation.”
Crespo highlighted that the lack of a legal representative in Brazil makes it “much more difficult” to comply with any court order, whether from the STF or other instances of the Judiciary.
He concluded by stating that, given technological changes, the Judiciary needs to adopt “more agile forms of communication” to deal with these situations.
