EYDAP will not participate in the External Water Supply System tender

EYDAP declares its inability to participate in a PPP tender of the External Water Supply System (EYS), unless its founding law is amended, after receiving a legal opinion.

Specifically, the company states:

In the financial statements and in the presentation of the financial results of 2020 that are posted on the website of our Company we had mentioned that the framework of the agreement with the Greek State “includes the regulation of institutional issues, such as the possibility of EYDAP participation in PPP tenders”.

Also in the financial statements of the first half of 2021 it was mentioned that “with a contract between the Greek State represented by the Minister of Infrastructure and Transport, the” Company EYDAP Fixed Assets “and EYDAP SA, the maintenance is assigned to EYDAP SA and operation of the External Water Supply System (EYS) of the major area of ​​the Capital for three years.After the expiration of this contract, the maintenance and operation of the EYS will be assigned by the Ministry of Infrastructure and Transport to contractor, who will be selected through a tender procedure in accordance with Law 3389/2005 (A ‘232), in which EYDAP intends to participate in a tender procedure. ”

Based on documented studies of EYDAP services, but also the opinion of an external legal advisor, the participation of EYDAP in the relevant tender is possible only if the founding law of the company is amended. It is noted that the founding law of EYDAP was made long before the implementation of Public-Private Partnerships (PPPs) and therefore does not provide for the possibility of EYDAP to participate in PPPs outside the Attica Region, where it operates.

The amendment of the founding law was not made until the deadline for submission of an expression of interest file on 20/1/2022, despite the relevant actions of the Company, and therefore, EYDAP can not participate in the first phase of the above tender.

It is noted that EYDAP will continue to operate and maintain the External Water Supply System (EYS) until the end of its relevant contract, as it has successfully done for the last 40 years, providing uninterrupted quality and affordable water in Attica, through of the accumulated know-how and experience it has.
