Federal judge says former director of Americanas must surrender in Portugal

The former director of Lojas Americanas Anna Christina Ramos Saicali is expected to hand herself in to Portuguese authorities at Lisbon airport on Sunday (30) and fly to Brazil. As a result, she will no longer be detained preventively.

The movement was authorized by judge Márcio Muniz Da Silva Carvalho, of the 10th Federal Criminal Court of Rio de Janeiro, after a request made by the executive’s defense.

This is a “consensual solution”, according to the judge, aligned with the Federal Police and the Federal Public Ministry (MPF).

“In reality, ANNA CHRISTINA RAMOS SAICALI must simply present herself to the Portuguese authorities at Lisbon airport, without being detained, handcuffed, or subjected to any type of embarrassment or humiliation, being accompanied by the police authorities until she boards the flight back to Brazil, and received by the Brazilian police authorities, to whom she must hand over her passport as requested by the Federal Public Prosecutor’s Office, submitting only to the precautionary measure of prohibiting her from leaving the country”, said the judge, in a decision signed on Friday night (28).

According to the judge, when ordering Saicali’s preventive detention, it was determined that the “presumption of escape could be disproved with the Investigated Person’s spontaneous presentation to the competent authorities, demonstrating her real intention of returning to Brazil”.

“In the manner proposed by the Police Authority and the Federal Public Ministry, this commitment will be met with a ‘lower personal burden’ for the Investigated Party, who will not even have to submit to the custody hearing”, wrote the judge.

Once Saicali turns himself in, his name is expected to be removed from Interpol’s wanted list.

Alongside the former CEO of Americanas, Miguel Gutierrez, Saicali was the subject of an arrest warrant in the operation investigating the company’s accounting fraud.

The arrest warrants were issued by the Federal Court of Rio de Janeiro following requests from the PF.

The pair were considered fugitives and had their names added to the Interpol list. Gutierrez was arrested in Madrid, Spain, on Friday morning (28).

The case

The PF and the MPF carried out an operation on Thursday (27) that aimed to investigate the participation of former directors of Americanas in the company’s accounting frauds.

Named “Disclosure”, the operation was monitored by the Securities and Exchange Commission (CVM).

The group investigated, according to the PF, would be responsible for the biggest fraud in the history of the Brazilian financial market, which was estimated at R$25.3 billion by the company itself.

Miguel Gutierrez is identified as a member of the fraudulent scheme.

Among the crimes investigated are: market manipulation, use of privileged information, criminal association and money laundering.
