The UN General Assembly approved on Wednesday (12) a resolution condemning the annexation of Ukrainian territories by Russia. Brazil was one of the 143 countries that were in favor of the project. Meanwhile, 5 nations voted against and another 35 abstained.

Nations opposing the project were Russia , Syria , Nicaragua , North Korea and Belarus .

On the other hand, South Africa, Algeria, Armenia, Bolivia, Burundi, Kazakhstan, China, Congo, Cuba, Eritrea, Ethiopia, Guinea, Honduras, India, Laos, Lesotho, Mali, Mongolia, Mozambique, Namibia, Pakistan, Kyrgyzstan, Central African Republic, Sudan, South Sudan, Sri Lanka, Swaziland, Thailand, Tajikistan, Tanzania, Togo, Uganda, Uzbekistan, Vietnam and Zimbabwe.

What does the resolution say?

According to the bill, the annexation of the Donetsk, Kherson, Luhansk and Zaporizhzhia regions is “a violation of the territorial integrity and sovereignty of Ukraine and incompatible with the principles of the Charter”. [da ONU]”.

It also recognizes that the referendums “have no validity under international law and do not constitute a basis for any change in the status of these regions of Ukraine”.

Another point of the resolution approved this Wednesday is the demand that Russia reverse decisions on the aforementioned regions. The UN also appeals to States and international organizations not to recognize the annexation and not to participate in negotiations or actions that could be interpreted as such.

Main points of the resolution

  1. Reaffirms its commitment to the sovereignty, independence, unity and territorial integrity of Ukraine within its internationally recognized borders, extending to its territorial waters;
  2. Condemns the Russian Federation’s organization of so-called illegal referendums in regions within Ukraine’s internationally recognized borders and the attempted illegal annexation of Donetsk, Kherson, Luhansk and Zaporizhzhia regions of Ukraine, following the organization of said referendums;
  3. Declares that the unlawful actions of the Russian Federation in relation to the so-called illegal referendums held from 23 to 27 September 2022 in parts of Donetsk, Kherson, Luhansk and Zaporizhzhia, regions of Ukraine which, in part, are or were under temporary military control of the Russian Federation, and the subsequent attempted illegal annexation of these regions, have no validity under international law and do not constitute the basis for any change in the status of these regions of Ukraine;
  4. Calls upon all States, international organizations and specialized agencies of the United Nations not to recognize any change by the Russian Federation of the status of any or all regions of Donetsk, Kherson, Luhansk or Zaporizhzhia, and to refrain from any action or negotiation that might be interpreted as acknowledging any changed status;
  5. Demands that the Russian Federation immediately and unconditionally reverse its decisions of February 21 and September 29, 2022 regarding the status of certain areas of the Donetsk, Kherson, Luhansk and Zaporizhzhia regions, as they are a violation of territorial integrity and sovereignty of Ukraine and incompatible with the principles of the Charter of the United Nations, and immediately, fully and unconditionally withdraw all its military forces from the territory of Ukraine within its internationally recognized borders;
  6. Welcomes the efforts of the United Nations, Member States and humanitarian organizations to respond to the humanitarian and refugee crisis;
  7. Welcomes and expresses its strong support for the continued efforts of the Secretary-General and Member States, and urges Member States and international organizations, including the Organization for Security and Cooperation in Europe and other international and regional organizations, to support the de-escalation the current situation and a peaceful resolution of the conflict through political dialogue, negotiation, mediation and other peaceful means, with respect to the sovereignty and territorial integrity of Ukraine within its recognized borders and in accordance with the principles of the Charter;
  8. Decides to postpone the eleventh emergency special session of the General Assembly temporarily and to authorize the President of the General Assembly to resume its meetings at the request of the Member States.
