This Wednesday (18), a 40-year-old man was hospitalized in São Paulo after being hit by a shot fired by his own gun during an MRI.

The magnetic field generated by the device pulled the gun from his waist and triggered the shot. He was in the laboratory accompanying his mother, who was performing the exam.

The victim is Leandro Mathias de Novaes, a lawyer with an active profile on social networks for the dissemination of weapons content.

With about 7,500 followers and almost 50,000 likes, he often uses TikTok to answer questions clarifying other people’s doubts about carrying a firearm.

“How much will I spend on a lawyer if I use my gun in self-defense?”, “What will I answer if I get caught with a CAC loaded gun?” and “Even the guy breaking down the gate of your house, he can’t shoot?” are some of the questions that Leandro recorded video giving his point of view.

In his profile, it is also possible to find a publication in support of former president Jair Bolsonaro (PL), who defends the population’s access to firearms.

Leandro’s post shows Bolsonaro protesting in Brasilia in favor of carrying a gun. “In 2005, a deputy protested alone in front of Congress. A warrior!”, writes the caption of the photo published by the lawyer.

Specialized in Criminal Law and Criminal Procedure, Leandro Mathias works in his own office in the city of Cotia, in the Greater São Paulo region.

In Cotia, he chairs the Rights and Prerogatives Committee of the Brazilian Bar Association (OAB) subsection and the Administrative Boards for Infraction Appeals (JARI).

The accident

A 40-year-old man was shot this Wednesday (18), in São Paulo, by his own pistol, during an MRI.

According to information from the incident report, the victim accompanied her mother during an examination.

During the examination, magnetism pulled the gun that was on his waist and fired a shot in the abdomen region. The case took place on Avenida Brigadeiro Luís Antônio, in the central region of São Paulo, around 4:30 pm.

According to the Civil Police, he had signed a magnetic field contraindication term for companions.

The man was taken to São Luiz Hospital, where he remains hospitalized.

The case was registered as a firearm shot by the 14th Police District, which requested technical expertise from the Institute of Criminalistics.

“Weapon was not mentioned”, says laboratory

The CURA group gave its opinion this Thursday (19) about the case that happened in its laboratory in Jardins, in São Paulo, and stated that the patient and the companion had been instructed about the removal of metallic objects.

“We reinforce that all accident prevention protocols were followed by the CURA team, as is customary in all units”, he said in a note.

“Both the patient and the companion were properly instructed regarding the procedures for accessing the examination room and warned about the removal of any and all metallic objects. Both signed a term of acknowledgment regarding this guidance, ”she added.

According to CURA, “despite these guidelines, the firearm was not mentioned by the companion, who entered the examination room with the object by his decision”.

The group also stated that the lawyer and his mother are receiving advice and follow-up, and the laboratory is collaborating with the police investigation.
