The MPRJ also pointed out that the environmental impacts caused by the unit were already subject to the prosecution before the incident, through a public civil action filed in 2013 against Exxonmobil Chemistry, then owner of the factory, due to the environmental contamination caused by the operation of the local.
With the sale of the factory, Cosan assumed the legal obligations of the process. In 2024, the company expressed interest in signing a Conduct Adjustment Agreement (TAC) with the MPRJ, aiming at repairing environmental damage caused by the factory operation.
However, negotiations were not completed due to the technical complexity for the definition of the value of the compensation. Now, with the fire, any TAC deal is suspended until the causes of the accident and their environmental impacts are fully determined, according to the prosecution.
The court granted a favorable injunction to the MPRJ, determining that the company would perform emergency measures to avoid further environmental impacts. The decision was upheld by the 1st Civil Chamber of the Rio de Janeiro Court of Justice (TJRJ), even after numerous appeals presented by Exxonmobil and, later, by Cosan.
However, the judgment of the merits of the action has not yet occurred, due to difficulties in conducting technical expertise and a notary error that resulted in the wrong filing of the process. The records were reconstituted in November 2024, and the MPRJ will charge the trial with the court.

The fire began in the middle of Saturday afternoon (8), in an oil factory in the region of Governador Island, north of the state capital.
