Five days later pill without prescription even for minors: the ok of the State Council

The five-day-later pill, Ella One, will continue to be bought by the girls they have less than 18 years old and who want to avoid unwanted pregnancy, without the obligation of a medical prescription. This was established by the Council of State, confirming the decision of the Lazio TAR of May 2021, which had rejected the appeal of some associations (including Italian Catholic Doctors, Family day, Association pro vita e famiglia, Movimento per la vita italiano) .

“The drug Ella One should not be confused with the drug regimen used for voluntary termination of pregnancy,” says the State Council. «The mechanism of action of the five days later pill is antiovulatory, i.e. it acts before implantation of the embryo “. From the scientific studies underlying the determination, as the judges specified, «it appears that the drug Ella One should not be confused with the drug regimen used for voluntary termination of pregnancy. No violation of the legislation on voluntary termination of pregnancy it is therefore configurable “.

The State Council also believes legitimizes Aifa’s decisionthe Italian Medicines Agency, of October 2020, to allow the purchase of the five days later pill, which is a drug for emergency contraception, to minors under 18 without a doctor’s prescription (as already happened also for the morning-after pill, Norlevo), “since the elimination of the medical prescription is not in conflict on the one hand with the right of the minor to correct information and on the other with the right of parents or of those who make them I went to take the place of the minor “.

Furthermore, adds the Council of State, i over-the-counter medications they are excluded “from the category of health treatments in the strict sense that involve a whole series of specific issues, including that of consent and more generally of the relationship between doctor and patient”.
