The Flamengo fan accused of throwing the glass bottle that killed Gabriella Anelli, from Palmeiras, in July 2023, will be tried by a popular jury, according to a decision by the São Paulo Court, this Friday (23). The date has yet to be set.
In the document, judge Marcela Raia de Sant'Anna maintained the preventive detention of Jonathan Messias Santos da Silva and denied the defendant's right to appeal for freedom. “The reasons that led to the decree of preventive detention still persist and are reinforced with this ruling. In fact, the crime attributed to the defendant is serious, heinous, committed before a football match, in the context of a fight between rival fans, which highlights the concrete offensive potential of the accused”, states the judge in her decision.
Marcela also says that the defendant knew he was being sought for “the crime” and left for his state (Rio de Janeiro) “without giving any satisfaction to the Authorities”.
3D reconstruction
The São Paulo Institute of Criminalistics carried out a 3D forensic analysis to recreate in virtual format the accident of death of a Palmeiras fan hit by a bottle near Allianz Parque, in July 2023.
According to experts, the result of the 3D analysis reinforced the possibility that Flamengo fan, Jonathan Messias Santos, had thrown the object that hit Gabriella Anelli.
To recreate and carry out the investigation, notes were taken, photographs were taken using conventional cameras, aerial photographs with a drone and the location was scanned using a laser device. The analysis of videos taken on cell phones of witnesses present at the time of the events also provided support.

The expert concluded that the images in the video and the frames “support the possibility already mentioned in a previous report” that Jonathan had thrown the bottle that injured a fan and caused Gabriella's death, due to a cut in the neck region.
Also according to the report, “Jonathan Messias Santos da Silva was in an environment conducive to viewing several people in front of him, whether on the side of the Flamengo fans or on the side of the Palmeiras fans. These people were Metropolitan Civil Guards, an inspector and fans from Palmeiras”.
About the case
Palmeiras fan, Gabriela Anelli, aged 23, who had been injured in a stampede on the outskirts of Allianz Parque, in the game between Palmeiras and Flamengo, died in July 2023, after being hit in the neck with a bottle.
The victim was hospitalized in serious condition in the ICU of Santa Casa de São Paulo, but did not survive the injuries.
The victim's father told journalists at the time this Monday that Gabriela's fun was watching Palmeiras games.
