Spain’s Supreme Court on Monday placed Antonio Brufau, president of the oil company Repsol, and Isidro Faine, former president of the Spanish Caixabank, under formal investigation for the second time as part of a spying case, Reuters reported.
Judge Manuel Garcia Castellon last year rejected an investigation into Brufau, Faine, Repsol and Caixabank, but three different judges ruled Monday to appeal against the prosecutor, former president of the construction company Sacyr and the left-wing political party Podemos.
Caixabank said in a statement that it was “convinced that these proceedings will lead to a new decision to dismiss the case” and that it would continue to work with the judiciary.
The Supreme Court is investigating whether Repsol and Caixabank hired a security company owned by former police chief Jose Manuel Villarejo to spy on Luis del Rivero in 2011 and 2012, when he was president of Sacyr.
The court is trying to determine whether Repsol and the bank, which at the time owned a stake in the oil company, hired Villarejo to help repel a takeover bid for Repsol by Sacyr and Mexican state-owned oil company Pemex.
According to the Spanish judicial system, no formal charges can be brought until the first phase of the investigation is completed and an investigation does not necessarily lead to a formal charge.
The research is part of a larger research with Villarejo at the center. The investigation has shaken the Spanish corporate sector, causing some damage to reputation, but without a clear impact on business so far.
