France: Court condemns state for attempted investigation into media company Mediapart

The Nanterre court condemned the French state for an attempted search made in 2019 at the premises of the media company Mediapart, which had made public audio excerpts of a conversation between a top official of the presidency of the Republic and a former employee of the presidential majority party, “Front”.

Following the release of the excerpts, the Paris prosecutor’s office ordered an investigation into “illegal possession of devices or technical devices that may allow monitoring of telecommunications or conversations” and “violation of privacy”. In this context, two prosecutors and three police officers had attempted to search the premises of Mediapart, in order to obtain the recordings, despite the fact that the company had promised to deliver them.

“The investigation at issue was neither necessary in a democratic society, nor proportionate to the objective pursued,” ruled the Nanterre court, ruling that it “constituted an interference with freedom of expression and constituted a risk of ‘violating the confidentiality of sources’, which is permitted” only in exceptional cases”.
